Classic Time Club general terms and conditions for online purchasing on www.classictimeclub.com (“Website”).

2.    Definitions

2.1.             "Business Day" means any day that is not a Saturday, Sunday, or public holiday in New South Wales, Australia.

2.2.             "Consumer" means any natural person or legal entity who enters into an Agreement with Classic Time Club.

2.3.           “Products” means items provided for sale on the Website

2.4.           “You” and “your” means the Consumer

2.5.           “We”, “us”, “our” means Classic Time Club

2.6.             "Agreement" means any agreement for the sale and delivery of Products concluded between Classic Time Club and the Consumer.

2.7.            "General Terms and Conditions" means these General Terms and Conditions of Classic Time Club.

2.8.            "Intellectual Property Rights" means all intellectual property rights relating to the Products and the Website.

2.9.           “Force Majeure Event” means any circumstance or event beyond the reasonable control of either party which prevents or delays the performance of any obligation under this Agreement (other than a payment obligation). This includes, but is not limited to: natural disasters (such as earthquakes, floods, fires, or severe storms), structural damage or building collapses, explosions or major accidents, acts of war or terrorism, civil unrest or riots, labour disputes or industrial action, actions or directives by local, state, or federal government authorities, failure, interruption, or delay of utility services (including electricity, water, or telecommunications), or failure or delays caused by third-party service providers, including manufacturers, banks, shipping carriers (e.g. Australia Post, DHL, FedEx), or any other critical supply chain providers.

3.    Applicability 

3.1.             These General Terms and Conditions apply to any Agreement for the sale and delivery of Products through the Website and form part of all quotations, offers, acceptances, acknowledgements, and confirmations related to orders made by the Consumer.

3.2.             By placing an order, the Consumer agrees to be bound by these General Terms and Conditions.

3.3.            These General Terms and Conditions supersede any previous general terms and conditions for sales through the Website.

4.    Customer Accounts

4.1.             If you create an account with us, you are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. 

4.2.            You must notify us immediately of any unauthorised use of your account or any other breach of security.

5.    Products

5.1.             Product Descriptions: The watches we sell are one of a kind and are used, vintage and or antique. We strive to provide accurate descriptions and condition assessments, but minor discrepancies may occur and shall not constitute grounds for a return or refund.

5.2.             Product Images: The images of the products on our website are for illustrative purposes only. While we strive to display the colours as accurately as possible, we cannot guarantee that your computer or device's display will reflect the true colours of the products. Your products may vary slightly from those images.

5.3.             Verification of Information: You agree to make your own inquiries to verify any information provided about the goods or services and to consider the suitability of those goods and services before making a purchase.

5.4.             Packaging Variations: The packaging of the products may vary from the images shown on our website.

5.5.             Custom items: If we are making a custom product based on information you have provided such as wrist measurements or watch measurements, it is your responsibility to ensure that all information is complete and accurate. We do not accept returns or refunds based on incomplete or inaccurate information. 

6.    Payment 

6.1.             All payments made through our website are secure and encrypted to ensure the protection of your personal and financial information.

6.2.             The default price of items on the Website are listed in AUD (Australian Dollars). If you are paying in a different currency, please be aware that the final amount may vary due to exchange rates and bank fees. 

6.3.             Prices for our Products may change from time to time, but changes will not affect any order you have already placed. We reserve the right to promote the same or similar Products with varying offers depending on the advertising route and/or time.

6.4.             We accept a variety of payment methods for your convenience: 

·         PayPal (subject to approval)

·         Credit Card (Visa, MasterCard, American Express) — Please note that there are associated fees for using a credit card. 

·         Bank Wire Transfer 

·         Electronic Transfer 

·         Cash (subject to approval)

6.5.             Please note that different forms of payments take varying times to process and clear into our accounts. 

6.6.             Payment must be received in full within two (2) business days of placing your order unless otherwise approved. We reserve the right to cancel your order and make the item available for sale if payment is not received within this time frame.

6.7.            Your order will be confirmed after we receive and verify your payment. You will receive an email confirmation with the details of your purchase.

6.8.             If you need to cancel your order, please contact us immediately. Once the order is shipped, our Return Policy will apply.

6.9.             You may not have a right to cancel where the Products are tailor-made or you have requested that they contain your name or initials or if you placed your order from outside Australia. 

6.10.         We take fraud prevention seriously. All orders are subject to verification and security checks. We reserve the right to cancel any order that appears suspicious or does not pass our verification process.

7.    Acceptance and Cancellation

7.1.             We shall on receipt of your order send you an e-mail acknowledging that the order has been received. However, this does not mean that your order has been accepted. 

7.2.             All orders are subject to availability of the Products and our acceptance. 

7.3.             We will communicate acceptance of your order by sending you an e-mail or messages at which point an Agreement will come into existence between you and us.

7.4.             Classic Time Club reserves the right to reject or cancel an order without liability in the following cases:

·       Product is unavailable or out of stock.

·       Order flagged as unusual or susceptible to fraud.

·       Incorrect or unverifiable billing information.

·       Error in price displayed.

·       Inability to deliver to the provided address

·       some other reason justifying cancellation

7.5.             We will inform you of the cancellation in writing and, where a Product is temporarily out of stock, ask if you wish to proceed with your purchase. If you do wish to proceed with your order, we will not be under any obligation to supply the Product until we know we can supply it and we have given you a confirmation.

7.6.             If we discover an error in connection with the price of the Products you have ordered, we will let you know as soon as possible after we become aware and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order in respect of that Product. Price errors in the offer do not bind Classic Time Club. We will not process your order in respect of that Product until we have received your instructions. If we are unable to contact you using the most up to date contact details that we have for you, we will treat the relevant part of the order as cancelled and notify you by email at the address provided to us. If we accept and process your order where a pricing error is obvious and unmistakable, we may end the contract, refund you any sums you have paid and require the return of any Products provided to you.

7.7.             If we cancel an order and you do not wish to proceed with your order, we will issue a refund within 10 working days, unless we have reasonable suspicions of fraudulent card payment. In cases where we reasonably suspect fraudulent payment by debit or credit card, we will withhold the dispatch of any goods and will not process any refunds until authorised by the Consumer’s bank.

7.8.             If you place an order for multiple Products and some of those Products are unavailable, we may process the order in respect of the available Products.

8.    Shipping and Delivery 

8.1.             We provide both domestic and international shipping through a selection of trusted couriers, including DHL, FedEx, Australia Post, Brinks, Malca-Amit, and others. The choice of courier is determined at our discretion, based on factors such as destination, value of the goods, and the speed and reliability of service. Should we be unable to ship to your address, we will contact you to discuss alternative arrangements.

8.2.             Unless explicitly stated otherwise, all shipping, handling, and transit insurance fees are covered by us. You are responsible for any import taxes and/or duties imposed by the destination country (Please refer to clauses 8.10 to 8.12). 

8.3.             You may choose to collect the order from our Showroom in Sydney, NSW, Australia but only by appointment and with prior notice.

8.4.             Once an order is placed and payment is received by us in full, we will prepare the watch and any accompanying box, papers and accessories ready for shipping typically within 2 Business Days from either our Australia or Hong Kong office.  Orders may be combined and shipped together if placed with the same shipping address. During this period, watches are visually inspected, mechanically tested and thoroughly photographed to document condition and functionality. In the event that a watch malfunctions, we reserve the right to delay handling so that our Watchmakers can diagnose and fix any malfunctions before shipping. Any such delays will be communicated to you and all expenses associated with diagnosing and fixing such malfunctions will be covered by us. 

8.5.             All watches are handled and packed securely on premises under CCTV surveillance to ensure the safety and security of your valuable goods. 

8.6.             It is your responsibility to ensure that the shipping address and contact information provided are accurate and complete. We are not liable for any delays, losses, or damage resulting from inaccurate or incomplete address information.

8.7.             Delivery times may vary depending on the destination and the shipping provider chosen. Orders within Australia are usually 1-3 Business Days, and the rest of the World is usually 3-10 Business Days. While we aim to ensure timely delivery, external factors such as courier processing, customs clearance, weather conditions, or other circumstances out of our control may cause delays. Delivery estimates are estimates only and should not be taken as a guarantee. We are not liable for damages or costs arising from delayed delivery.

8.8.             All packages ship with detailed tracking. Once your package is prepared and dispatched, we will provide you with tracking details for you to monitor the status of your package. 

8.9.             All packages require signature upon delivery. We cannot be held responsible for any claims of loss or damage in cases where a package is not signed for by you or where it has been redirected without our written authorization.

8.10.         For orders shipped outside of Australia or Hong Kong, the recipient may be subject to import duties, taxes, and other fees imposed by the destination country’s customs authorities. These charges are the responsibility of the recipient and are beyond our control. We do not accept any return or refund claims on the customs and duties basis. We recommend contacting your local customs office for more information regarding potential fees before placing your order.

8.11.         From time to time, orders shipped to Australia may also incur import duties and taxes if the item is located in our Hong Kong office. Such orders will be communicated to the prospective buyer before the package is en route. 

8.12.         It is your responsibility to comply with the laws and regulations of the destination country. Any delays, rejections, or additional costs incurred due to non-compliance with customs requirements are at the recipient's expense.

8.13.        Ownership of the Product remains with us until full payment is received. Risks pass to you at the time of delivery.

8.14.         If you refuse or fail to accept delivery, you will be responsible for arranging alternative delivery. 

8.15.         Delivery of the Goods will be completed when they have been delivered to the address provided in the order or collected in person.

8.16.         In the event that an item is returned to Classic Time Club due to the purchaser’s refusal or failure to pay applicable import duties, taxes, or to take delivery from customs or the relevant carrier, the purchaser shall remain fully liable for all costs associated with the return, storage, and subsequent re-delivery of the item. Classic Time Club may arrange for the item to be re-shipped to the purchaser once all outstanding charges, including but not limited to additional shipping, insurance, customs clearance, and administrative handling fees, have been paid in full by the purchaser. Such refusal or failure to take delivery shall not be deemed a valid basis for cancellation of the sale or entitlement to a refund. Items returned due to non-collection or abandonment shall not be refunded under any circumstances. Classic Time Club reserves the right to recover any losses incurred as a result of the purchaser’s non-compliance, including through legal proceedings or debt recovery action where applicable.

9.    Return and Refunds 

9.1.             Classic Time Club specialises in the sale of pre-owned watches. While all watches are thoroughly inspected, guaranteed authentic, and covered by our Warranty Policy, they are considered collectible objects. As such, we do not accept returns if a watch does not meet performance claims made by the original manufacturer and cannot guarantee that any watch will meet factory specifications.

9.2.             We do not accept returns or offer refunds under any circumstances, including change-of-mind purchases. Watches sold by Classic Time Club are intended for collectors and retail buyers only; we are under no obligation to repurchase or accept returns of any watches sold. Buyers are strongly encouraged to review all photos and descriptions carefully and to ask any necessary questions prior to purchase.

9.3.             Returns are only accepted in the event of a successful claim under our Authenticity Guarantee. For full details and return procedures relating to authenticity claims, please refer to our Authenticity Guarantee. 

10. Warranty

10.1.        Watches sold by Classic Time Club are thoroughly inspected and serviced if necessary, prior to sale. Where servicing has been performed, it may have been carried out by the original manufacturer or our watchmaker. This does not affect the functionality or validity of our warranty. Our team of experts ensures that all watches meet our high standards of quality and functionality. 

10.2.         We provide a 12-month warranty (‘Our Warranty’) on all watches unless otherwise specified. Our Warranty covers mechanical defects relating to the movement and operation of the watch. 

10.3.         We guarantee that all watches are in Working Condition at the time of sale unless otherwise specified. Working Condition generally means that the basic functions of the watch such as hours, minutes, seconds, date, chronograph, or any other applicable complication are in working condition. The definition of Working Condition does not extend to any guarantees on timekeeping accuracy nor resistance to water or moisture. 

10.4.         We specialise in the sale of second hand, vintage and antique goods. We are not an authorised distributor for the watch brands we sell nor do we advertise our watches to be new. We try our best to document the cosmetic condition of our goods through a combination of photos, videos and descriptions. It is your responsibility to review all available material and form your own opinion on the cosmetic condition of our watches. Any reference made by us regarding cosmetic conditions (e.g. ‘Excellent Condition’, ‘Unpolished’, ‘Unworn’ etc.) are our opinion only and should not be taken as guarantees.

10.5.         Classic Time Club sells pre-owned watches, many of which are vintage or decades old. As such, we do not warrant or represent that any watch will continue to meet its original manufacturer specifications, including but not limited to COSC or chronometer certification standards, water resistance, shock resistance, anti-magnetism, or timekeeping accuracy. Any original factory guarantees or performance claims do not apply, and no reliance should be placed on such specifications unless explicitly confirmed by us in writing at the time of sale. All watches are sold as-is, unless otherwise stated.

10.6.         Our Warranty does not cover the following:

·       Timekeeping accuracy

·       Waterproofness

·       Normal wear and tear

·       Damage as a result of improper use

·       Damage as a result of moisture, steam or water

·       Damage as a result of unauthorised repair 

·       Damage caused by any third party

·       Damage to the crystal, dial, crown, external pushers, strap or bracelet.

10.7.         Our warranty is non-transferable and valid only for you. Our Warranty is void if there is any change of possession or break in the chain of custody. 

10.8.         Our Warranty is void if there is any evidence of water or moisture within the case, movement or internal components. 

10.9.         Our Warranty is void if there is any unauthorised access to the case, movement or internal components for the purpose of assessment, adjustment, repair or modification. Any request for third-party verification or opening of the caseback must be approved in writing by us. Unauthorised opening or handling will void all warranties and may impact your eligibility for authenticity claims. We recommend using only our authorised service centres for any repairs or servicing needs.

10.10.     For claims against Our Warranty, please email us at info@classictimeclub.com with the following information:

·       Proof of purchase

·       Detailed description of the issue or malfunction

·       Photographs or videos demonstrating the issue or malfunction

10.11.      We will respond to your claim within 7 business days and determine if it is covered under Our Warranty. We may contact you and request for further information or request that the watch be shipped to us for assessment. 

10.12.     Claims against Our Warranty must be assessed by us. We reserve the right to reject findings and/or opinions of a third party.

10.13.     You are responsible for shipping/and or delivering the watch to us. We strongly recommend you use a trackable, insured shipping service and pack the watch securely to ensure safe transit. 

10.14.     You are responsible for the cost of shipping and insurance associated with the transit of your watch to us. If you are outside of Australia, you may also be required to pay certain charges, taxes or custom duties levied by the Australian tax department. If you are uncertain about whether these charges will apply to you, please contact us. 

10.15.    Once we receive your watch, we will assess the watch against your claims and will advise as soon as practicable whether your claims are covered under our Warranty Policy. 

10.16.     If a successful claim has been made, we will attend to the repair of your watch back to Working Condition with time not being of the essence for any works carried out under warranty. If it is still covered by the Manufacturer’s Warranty, we reserve the right to proceed with the works through the Manufacturer’s Warranty first.

10.17.     Once work has been completed under warranty, we will notify you and arrange the delivery or collection of your watch back to you. 

10.18.     We will cover the shipping and insurance cost when delivering the watch back to you. If the delivery destination is located outside of Australia, you may be required to pay import duties, taxes, fees, or other charges imposed by customs or authorities in the destination country. You are responsible for complying with all laws and regulations of the country where you receive the goods. Any additional charges imposed by customs is your responsibility; we have no control over these charges and cannot predict their amount. If you are unsure whether these charges will apply to your order, please contact your local tax or customs office for more information.

10.19.     Our liability under this warranty is limited to the repair or replacement of the defective part. We are not responsible for any indirect, incidental, or consequential damages arising from the use or inability to use the watch.

10.20.    We have absolute discretion as to the acceptance of any claim against the warranty. In the event of a dispute, we reserve the right to instruct an independent third-party watchmaker to determine the appropriate course of action. The decision of the independent, third-party watchmaker will be binding on both parties.

11. Authenticity Guarantee

11.1.         Watches sold by Classic Time Club are thoroughly inspected and authenticated prior to sale. We guarantee the authenticity of our watches at the time of sale. 

11.2.         We stand behind our Authenticity Guarantee and will restore, replace or refund your purchase if the watch or its accompanying warranty papers is established to be counterfeit.

11.3.         Our Guarantee excludes components that are considered perishable or routinely replaced as part of standard servicing. This includes, but is not limited to: lubricants, seals, gaskets, crystals, leather straps, buckles, spring bars, bracelet pins, batteries, mainsprings, and other consumable parts typically changed during regular maintenance over the life of the watch.

11.4.         Our Guarantee does not apply where aftermarket parts have been installed and disclosed to you before purchase. 

11.5.          Our Guarantee is non-transferable and valid only for the purchaser. Our Guarantee is void if there is any change of possession or break in the chain of custody. 

11.6.         To initiate a claim against our Authenticity Guarantee, please email us at info@classictimeclub.com with the following information:

·         Proof of purchase 

·         Photographs or videos clearly showing any part(s) you believe to be  counterfeit

·         A detailed description of how you formed your opinion

11.7.         We will respond to your claim within 7 business days and arrange for the watch to be shipped to us for assessment. 

11.8.         Claims against our Authenticity Guarantee must be assessed by us or by an independent third-party watchmaker nominated by us. 

11.9.          If we determine that the watch or its accompanying warranty papers are counterfeit, we will restore, replace or refund your original purchase and cover any shipping fees you have incurred when sending the watch to us for assessment.

11.10.      In the event of a dispute, we reserve the right to nominate an independent third party and/or the original Manufacturer to assess and determine authenticity. 

11.11.     Any claims against our Authenticity Guarantee are taken extremely seriously with time not being of the essence during this careful determination. 

11.12.     We reserve the right to reject a claim if the watch has been opened, repaired, modified or otherwise handled by an unauthorised third party. 

11.13.     You are responsible for shipping/and or delivering the watch to us for assessment. We strongly recommend you use a trackable, insured shipping service and pack the watch securely to ensure a safe transit. Any loss or damage during return shipping is your responsibility.

11.14.     You are responsible for the cost of shipping and insurance associated with the transit of your watch to us. If you are outside of Australia, you may also be required to pay certain charges, taxes or custom duties levied by the Australian tax department. If you are uncertain about whether these charges will apply to you, please contact us. You must ensure that all customs documentation is correctly completed to avoid delays or additional charges. 

11.15.     The maximum liability upon a successful claim is the original purchase price plus any shipping fees you have incurred when sending the watch to us. We are not liable for any additional costs, taxes or damages incurred.

12. Force Majeure Event

12.1.         If a Force Majeure Event takes place that affects the performance of our obligations: 

a) we will contact you as soon as reasonably possible; and 

b) our obligations under these Terms will be suspended and the time for performance will be extended for the duration of the Force Majeure Event. 

12.2.         Where the Force Majeure Event affects our delivery of Products to you, we will arrange a new delivery date with you after the Force Majeure Event is over.

12.3.         Neither party is liable for delay or failure to perform any obligation (other than a payment obligation) caused by a Force Majeure Event, being an event beyond its reasonable control which it could not have prevented by reasonable precautions. The affected party must notify the other without undue delay and use reasonable endeavours to mitigate the effect. If the Event continues for more than 60 days, either party may terminate the affected contract on written notice. 

13. Liability

13.1.         We supply Products for domestic and private use. Accordingly, if you use the Products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

13.2.         We are not liable for indirect incidental, or consequential loss or damage arising from the use or inability to use the watch.

13.3.         Aggregate liability is limited to the invoice value of the Product concerned.

14. Intellectual Property Rights 

14.1.         All content on the Website, including logos, images, and text, is owned by Classic Time Club and is protected by intellectual property laws. The Consumer cannot use or reproduce any content without the prior written consent of Classic Time Club.

14.2.         The Consumer cannot copy Products or any part of the Classic Time Club Website without written approval.

14.3.         All Intellectual Property Rights remain with Classic Time Club or its licensors. 

14.4.         No licence or rights to Intellectual Property are granted to the Consumer.

15. Privacy 

15.1.         Classic Time Club collects, uses, and protects the Consumer’s personal information in accordance with the Privacy Policy, which is available on Classic Time Club Website.

16. Website Availability 

16.1.         Classic Time Club does not guarantee continuous availability of the Website. Access may be suspended or discontinued without notice.

17. Miscellaneous 

17.1.         Invalidity or unenforceability of any provision does not affect other provisions. Replacements will be as close as possible to the intent of the original provision.

17.2.         Classic Time Club reserves the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on Classic Time Club Website.

17.3.         Classic Time Club may transfer its rights and obligations under the Agreement. The Consumer may only transfer their rights with written approval.

18. Governing Law and Jurisdiction 

18.1.         These Terms and Conditions and the Agreement are governed by the laws of New South Wales, Australia, excluding conflict of law rules.

18.2.         The courts of New South Wales, Australia, have exclusive jurisdiction over any disputes.

18.3.         Any disputes arising from these Terms and Conditions or the use of the Website shall be resolved through arbitration or mediation, as agreed upon by both parties. If arbitration is not agreed upon, disputes will be resolved in the courts of NSW, Australia.

19. Cookies and Tracking Technologies

19.1.         Classic Time Club uses cookies and tracking technologies to enhance the Consumer’s experience on the Website. For more information, please refer to the Cookies Notice.

20. Accessibility

20.1.         Classic Time Club strives to make the Terms and Conditions easily accessible from all pages of the Website. If you have difficulty accessing any part of our Terms, please contact us for assistance.
